§ 30-147. Suspension and reissuance of permit.
(a)
Suspension. At any time a suspension of the permit shall be determined, the health officer, subject to the provisions of sections 30-142, 30-143, 30-144 and 30-145, shall immediately suspend the permit of such frozen dairy products or mix manufacturing plant.
(b)
Right to reissuance. Any frozen dairy products or mix manufacturing plant whose permit has been suspended by the health officer may at any time make application for the reissuing of the permit.
(c)
Correction of unsatisfactory conditions. In case the suspension of the permit is the result of an unsatisfactory bacterial condition, cooling temperature or pasteurization process, the application must be accompanied by a statement signed by the applicant to the effect that the cause of the unsatisfactory condition has been corrected. If the suspension was due to an unsatisfactory bacteria analysis, proper lab tests must accompany the application for reinstatement of permit. Within one week of the receipt of such an application and statement, the health officer shall make a reinspection, and thereafter as many additional reinspections and investigations as he may deem necessary to assure himself that the cause of the unsatisfactory bacterial condition, cooling temperature or pasteurization process has been corrected. In case the findings indicate correction of the cause, the health officer shall reinstate the permit.
(d)
Correction of violations of sanitation requirements. In case the suspension of the permit is due to the violation of any item of the specifications prescribed in section 30-155, the application must be accompanied by a statement signed by the applicant to the effect that the violated items of the specifications have been conformed with. Within one week of the receipt of such an application and statement, the health officer shall make a reinspection and thereafter as many additional reinspections as he may deem necessary to assure himself that the applicant is again complying with the requirements, and, in case the findings indicate compliance, shall reissue the permit.
