§ 30-145. Permit for manufacturing plants in other cities.
Any mix manufacturing plant or frozen dairy products plant located in another city where inspections and health requirement standards equal to those imposed by this article are enforced must be approved and be issued a permit before its products can be sold in the city. Before approval can be granted to such a plant, a health officer must:
(1)
Secure a written request for approval by the plant in question.
(2)
Satisfy himself that the health requirement standards are comparable.
(3)
Secure a formal application from the plant requesting approval, and a certified statement from the inspecting authority that the plant is substantially in compliance with the latest edition of the Frozen Desserts Ordinance and Code recommended by the United States Public Health Service, Food and Drug Administration, and is under routine inspection and laboratory control. A personal inspection of the plant requesting a permit may be made before a permit is issued, or at other times as the health officer may deem necessary. The expenses of these inspections will be paid by the applicant for a permit or the permit holder.
(4)
After approval has been given to such a plant and before a permit is issued, an inspection fee of $200.00 per calendar year, prorated, shall be paid.
(5)
Once a plant has been approved, a permit may be renewed upon the payment of an annual inspection fee of $200.00, accompanied by a certification from the inspecting authority that the plant is substantially in compliance with the latest edition of the Frozen Desserts Ordinance and Code recommended by the United States Public Health Service, Food and Drug Administration, provided that the plant in question continues to maintain a satisfactory record with the inspecting authority and tests completed by the city's laboratory are within prescribed limits.
(6)
If a plant requesting or presently holding a permit is to act as a jobber or distributor for products from other sources, and these other source products are to be sent into the city, the plant manufacturing these products must also be issued a permit by the health department by submitting an application and a certification from their inspecting agency as outlined in subsection (3) of this section. However, in this type operation the initial permit fee will be $50.00 and the permit renewal fee will be $50.00. These reduced fees will not be prorated and must be accompanied with a certification as outlined in subsection (3) of this section.
