§ 30-144. Inspection fee.
(a)
Payment. Frozen dairy products plants and mix manufacturing plants under the inspection of the city shall pay annually in advance for their permits an inspection fee as set forth in this section; provided that, where a mix manufacturing plant also conducts the operations of a frozen dairy products plant, only one permit shall be required.
(b)
Due date; amount. Frozen dairy plants or mix manufacturing plants under the inspection of the city shall pay to the health department annually, on or before January 31, or before the establishment opens for business during the calendar year if such establishment normally begins business after January 1, inspection fees at the following rates:
(1)
Initial permit issued prior to October 1: $25.00.
(2)
Initial permit issued October 1 or after: $6.25.
(3)
Permit renewal:
a.
For each plant manufacturing, processing or freezing annually 1,000 gallons of mix or less, the renewal fee shall be $25.00.
b.
For each plant manufacturing, processing or freezing annually over 1,000 gallons but less than 17,000 gallons of mix, the renewal fee shall be $25.00, plus an additional fee of $5.00 per 1,000 gallons over the initial 1,000 gallons of mix.
c.
For each plant manufacturing, processing or freezing annually 17,000 gallons of mix, the renewal fee shall be $100.00, plus an additional fee of $2.00 per 1,000 gallons for each additional 1,000 gallons over 17,000 gallons of mix.
d.
The maximum renewal fee assessed on a gallonage basis shall not exceed $400.00.
e.
A mileage fee shall be paid by all frozen dairy products plants and manufacturing plants located outside the city which are routinely inspected by the city health department. This shall include all plants located outside the city limits which are not included under section 30-145. Such mileage shall be figured by the following formula: number of miles from the city hall and return times $0.12, times five, which is considered the average number of necessary inspections per year.
(c)
Basis of inspection fees. The inspection fees set out in subsection (b) of this section shall be based on volume reports submitted on or before January 10 by the mix manufacturing plant requesting permit renewal, and these reports will be based on the previous year's volume. The total volume of mix manufactured by the plant and the disposition of the mix shall be reported; provided, however, that establishments which do not manufacture mix are not required to submit volume reports. Such reports shall be furnished by the mix manufacturing plant which has supplied such establishment during the previous year. Frozen dairy products plants or mix manufacturing plants paying the maximum fee need not submit volume reports on their own operations. Any person paying an inspection fee as a mix manufacturing plant shall not be required to pay a separate or additional fee for a separate frozen dairy products plant that is engaged principally in retail dispensing and sales.
