§ 2-602. Powers and duties of director.

(a)

Generally. The director of convention and entertainment facilities is responsible for the management and operation of all public convention and entertainment facilities, including but not limited to the Convention Center (Conference Center, Bartle Hall, Municipal Auditorium, Barney Allis Plaza) and the American Royal Center (Crosby Kemper Memorial Arena and the American Royal Complex, including Hale Arena, Governor's Exposition Building, Sutherland Exhibit Hall, Harsh Exhibit Hall and Wagstaff Theatre), the Sprint Center, and such other enterprises and facilities as may be provided by ordinance. The director shall have the authority to appoint such assistants and other employees as may be necessary to perform the functions of the department.

(b)

Rules and regulations for conduct of department and operation of facilities . The director has the power to prescribe and enforce rules and regulations, not inconsistent with the Charter, for the conduct of the officers and employees of the department, and to prescribe and enforce such rules and regulations as he or she may deem proper for the efficient management and operation of the facilities under his control and the department, for the distribution and performance of business of such department, and for the custody and preservation of the books, records, papers and property under his or her supervision and control.

(c)

Contracts and leases. The director has the power and authority to sign all contracts for the leasing of all or any part of the facilities under his authority, but shall not sign any contract for any exhibition, entertainment or use which may be contrary to the statutes of the state or the ordinances of the city. He or she must collect and promptly turn over to the city treasurer all moneys belonging to the city received by him on account of rentals for all or any part of the facilities.

The director may refuse use of the convention facilities when the director determines that the proposed event will have an adverse effect on the public health, safety, welfare or morals, or when the director reasonably anticipates that the proposed event will cause damage to the facility beyond normal wear and tear.

The director may impose charges for special facilities and extra services, including but not limited to additional sound equipment, expenses for broadcasting, special seating arrangements, rehearsal occupancies, event operations beyond regularly scheduled hours, erection of platforms and stands other than those usually furnished, and higher than normal consumption of utilities. Such charges are subject to the approval of the management advisory authority.

No person may use any convention and entertainment facility or any pat of any such facility without a written contract, license, lease or concession agreement with the city.

(d)

Catering. The director may enter into facilities use licenses to provide food or beverage in the convention facilities (catering permits). The terms and conditions of such licenses are subject to the approval of the management advisory authority.

(e)

Tickets and account control. The director is authorized to prescribe the forms of tickets, account, records and reports to be used by any licensee. The director or his or her designee is authorized to investigate or inspect the licensee's tickets, accounts, records and reports as he or she may determine necessary for verification of the amount of gross receipts.

The director and the licensee will mutually agree on the price schedule. If there are unauthorized deviations from the mutually agreed prices, the licensee will compute the city's proceeds on the basis of the mutually agreed prices. The licensee will secure all admission or other tickets from a bonded ticket printer approved by the director. The ticket printer will transmit all tickets directly to the director. The director may authorize substitution of a notarized ticket manifest in lieu of transmittal of the tickets to the director. The type and number of complimentary tickets issued by a licensee must be approved by the director. If the licensee issues complimentary tickets in excess of the number approved by the director, the licensee must account for the excess unpaid admissions as though the full admission charge had been paid.

(f)

Promotional programs. The director has the power to conduct such promotional programs as may be necessary or desirable with respect to the facilities under his or her management and control.

(g)

Additional duties. The director will perform such duties in connection with the operation of the facilities under his or her management and control as may be directed by the city manager or by ordinance.
