§ 70-175. Same—Disposition and records.
(a)
The chief of police, or other responsible officer, shall cause the information copy of every traffic ticket issued to an alleged violator of any provision of this chapter to be deposited with the court, in the manner provided by law or court rule.
(b)
Upon the deposit of such traffic ticket with the court, the traffic ticket may be disposed of only by trial in the court, or other official action by a judge of the court, including forfeiture of bail, or by payment of a fine, when authorized by court rule, in the traffic violations bureau; however, the provisions of this subsection shall not apply to cases which are nolle prossed by the city prosecutor.
(c)
It shall be unlawful and official misconduct for any police officer or other officer or public employee to dispose of, alter or deface a traffic ticket or any copies thereof, or the record of the issuance or disposition of any traffic ticket or warrant in a manner other than authorized.
(d)
The chief of police, or other responsible officer, shall require the return to him of every traffic ticket issued to an alleged violator of any provision of this chapter, including all copies thereof which have been spoiled or upon which any entry has been made and not issued to an alleged violator.
(e)
The court shall require the return to the court of each traffic ticket, and all copies thereof which have been spoiled or upon which any entry has been made and which have not been issued to an alleged violator. Such latter cases shall require a concise statement by the officer, approved by his immediate supervisor, as to the reason the ticket was spoiled or not issued.
(f)
The chief of police shall maintain or cause to be maintained, in connection with every traffic ticket, a record of the disposition of the charge by the court or its traffic violations bureau in which the original or copy of the traffic ticket was deposited.
(g)
The chief of police shall maintain or cause to be maintained a record of all warrants issued and directed to him by the court and of the final disposition thereof.
