Chapter 50. OFFENSES AND MISCELLANEOUS PROVISIONS |
Article IX. CONSUMER PROTECTION |
§ 50-299. Assurance of voluntary compliance.
In the enforcement of this article, in lieu of filing an information or complaint, the city counselor may give written authorization to the supervisor to accept a written assurance of voluntary compliance with respect to any practice alleged to be violative of section 50-292 from any person who is engaged or about to engage in such practice. Such assurance may include a stipulation for the voluntary payment by the alleged violator of any amounts necessary to restore to any person any money or property which may have been acquired by such alleged violator by means of any such practice. Such assurance of voluntary compliance shall not be considered evidence of or an admission of violation for any purpose; however, violation of an assurance entered into pursuant to this section shall be a violation of this article and shall be subject to all the penalties provided therefor. All assurances of voluntary compliance shall be made a matter of public record.
