§ 34-145. Bond or insurance.

  • (a)

    The applicant for the fumigation permit required by section 34-144 shall furnish the city and keep in effect a liability bond in the amount of $10,000.00, with surety to be approved by the director of finance, conditioned that the principal shall comply with all provisions of this article, and will indemnify any person damaged or injured by such fumigation in a manner in violation of this article, and will indemnify the person entitled to recover on account of the death of any person caused by such fumigation in a manner in violation of this article.

    (b)

    In lieu of such bond, such applicant may furnish and file with the director of finance a policy or certificate of liability insurance acceptable to and approved by the director of finance and approved as to form and legality by the city counselor, issued by an insurance company authorized and licensed to do business in the state, or issued by another insurance company if it is shown that the statutes of the state and rules of the state insurance department authorize the placing of such insurance with such company and that such statutes and rules have been complied with, insuring such applicant against any and all loss by reason of damage or death that may result to any persons from the use of any such gases, which policy or certificate of insurance shall guarantee payment of all final judgments recovered against such applicant by reason of any such loss, damage, injuries or death.
