§ 2-1456. Delivery of defendant for confinement on failure to pay execution.

  • Upon receiving the execution referred to in section 2-1454, the chief of police, except when indigency is claimed and determined by the court, shall immediately take the defendant into custody, and, if such defendant does not immediately satisfy such execution, either by paying the execution in money or by delivering to the chief of police sufficient goods and chattels, the property of the defendant, whereupon to levy such execution for debt and costs, the chief of police shall, without delay, deliver or cause to be delivered to the superintendent of the municipal correctional institution such defendant, who shall be confined at the municipal correctional institution.
