§ 2-82. Acting city manager.

  • (a)

    In case of the absence or disability of the city manager, the council may designate some qualified person to perform the duties of this office, and the person so designated shall have authority and it shall be his duty to perform the duties of city manager during such absence or disability of the city manager, and such acting city manager shall be removable peremptorily at the will of the council.

    (b)

    In case of the temporary absence of the city manager from the city on business or vacation for a period not exceeding 60 calendar days, the council designates any assistant city manager, the city counselor, the director of finance or the director of human resources as persons qualified to perform his duties during his temporary absence from the city.

    (c)

    The city manager is hereby authorized to select any one of the qualified officials named in subsection (b) of this section to serve as acting city manager and to perform the city manager's duties during his temporary absence from the city.

    (d)

    The authority granted by this section shall be limited to temporary absence for business purposes or for vacations, and the authority granted by this section shall not be construed to delegate to the city manager any legislative power of the council to designate an acting city manager during any extended absence or disability of the city manager.

    (e)

    If a duly appointed acting city manager is unable to perform or fill such office, the mayor shall designate an acting city manager, who will serve until the return of the duly appointed acting city manager or until such time as the council designates another acting city manager.
