§ 22-3. Return of assessments paid if proceedings declared invalid or property not acquired.

  • In all condemnation or grading cases where benefits have been or may hereafter be assessed and where payments of such assessments have been or may hereafter be made to the city treasurer, whenever the judgment and proceedings under which such assessments are paid are for any reason declared invalid, or the property condemned is not acquired by the city, or the grading improvement is not made, the director of finance is hereby authorized and directed, upon the return of the receipt given by the treasurer upon the payment of such benefits, to draw a warrant for the amount paid to the city treasurer in favor of the person to whom the receipt of the treasurer was given, such payment to be made out of the special fund in the proceedings in which the payment was made.
