§ 70-860. Vehicles transporting hazardous materials.

  • (a)

    It is unlawful for any person to operate any vehicle upon any highway of this state, whether in intrastate transportation or interstate transportation, transporting materials defined and classified as hazardous by the United States Department of Transportation pursuant to title 49 of the Code of Federal Regulations, as amended, unless such vehicle is equipped with the equipment required by and is operated in accordance with safety and hazardous materials regulations for such vehicles as adopted by the United States Department of Transportation, specifically parts 171 through 181, title 49 of the Code of Federal Regulations, as amended.

    (b)

    A person convicted of violating any provision of this section shall be punished by a fine of not less than $50.00 and not more than $500.00, or by imprisonment in the place designated by law for not less than two days and not more than six months, or by both such fine and imprisonment.
