§ 6-82. Penalties.

  • (a)

    Each violation of the regulations of this article or of any order or ruling promulgated under this article shall constitute an air navigation obstruction and an ordinance violation, and such obstruction shall be removed by proper legal proceedings and such ordinance violation shall be punished by a fine of not more than $200.00.

    (b)

    In addition, the department may institute in the circuit court of Clay, Jackson, Platte or Cass Counties, in whichever county the airport obstruction area is located, in whole or in part, in connection with which the regulations of this article were adopted, an action to prevent and restrain, correct or abate any violation of the regulations of this article or of any order or ruling made in connection with their administration or enforcement, and the court shall adjudge such relief by way of injunction, which may be mandatory or otherwise as may be proper under all the facts and circumstances of the case, in order to fully effectuate the purposes of the regulations of this article as adopted, and orders and rulings made pursuant hereto.
