§ 6-79. Permits for nonconforming uses.
(a)
New uses. No material change shall be made in the use of land and no structure shall be erected, altered, planted or otherwise established in an airport height zone as defined herein, unless the permit therefore shall have been applied for and granted. Each such application shall indicate the purpose for which the permit is desired with sufficient particularity to permit it to be determined whether the resulting use or structure would conform to the regulations prescribed in this article.
(b)
Existing uses. Before any existing nonconforming height, condition or effect may be replaced, substantially altered or repaired, rebuilt or allowed to grow higher, within any airport height zone, a permit must be secured authorizing such replacement, change or repair. No such permit shall be granted that would allow the establishment or creation of an air navigation obstruction, or permit a nonconforming use or structure to be made or become higher or become a greater hazard to air navigation than it was on the effective date of the ordinance codified in this article or than it is when the application for a permit is made.
