§ 64-131. Penalty for violation of article.

  • (a)

    Any person violating any provision of this article shall be deemed guilty of an ordinance violation. The municipal court shall have the power to hear and determine alleged violations of the provisions of this article. All persons convicted of violations under this article shall be punished by a fine of not less than $500.00 and not more than $500.00, or by imprisonment in the municipal correctional institution for a term not to exceed six months, or by both a fine and imprisonment. A person who fails to pay any fine assessed upon conviction under this article may be committed to the municipal correctional institution until the fine is paid at the current per diem rate and the judgment of the court satisfied.

    (b)

    Each day that a violation of this article continues shall be deemed a separate offense and shall be proceeded against as in the first instance. In addition, any violation of any provision of this article shall be grounds for revocation of any permit issued under this article.
