Chapter 64. STREETS, SIDEWALKS AND PUBLIC PLACES |
Article I. IN GENERAL |
§ 64-7. Permit for operating vehicle of excess length or weight on streets.
(a)
Generally. The director of public works, with respect to highways under his jurisdiction, for good cause shown and when the public safety or public interest so justifies, may issue in writing a special permit authorizing the applicant to operate or move a vehicle or combination of vehicles of a length or weight exceeding the maximum specified in this Code upon highways or streets under jurisdiction of the city for the purpose of moving such vehicle or combination of vehicles to and from the Kansas Turnpike.
(b)
Conditions; conformance with state regulations. The special permit shall be limited to operation between the hours of 6:00 p.m. and 6:00 a.m. and shall be limited to 108 feet maximum total vehicular length, including combination of vehicles, and 130,000 pounds total weight. Such permits shall be issued only for a single trip or for a definite period, not beyond the date of expiration of the vehicle registration, and shall designate the highways and bridges which may be used under the authority of the special permit. The issuance of the special permit shall be prescribed by rules and regulations enacted by the state highways and transportation commission as filed with the secretary of state; however, any such rule and regulation suspended or disapproved by the joint committee on administrative rules for the state legislature or by the general assembly pursuant to RSMo 304.200(a) shall be disregarded. Such special permits designating a definite period of continuous operation may be applied for at any time throughout the calendar year.
(c)
Application; bond; authority to impose additional restrictions. The application for any such special permit shall be in writing and shall specifically set forth the name of the applicant, the address and telephone number of the applicant's dispatcher, the model number and serial number of each power unit to be used, the description of the vehicle or combination of vehicles to be used, including their length, weight and height, the nature, dimensions and weights of loads to be operated and moved and the designated streets or highways for which the special permit to operate is requested, and whether such permit is requested for a single trip or for a definite period of continuous operation. The director of public works may further specify thereon other limits, restrictions or conditions of operation of such vehicles when necessary to protect against undue damage to road foundations, surfaces, structures, bridges or other public property, and may require the posting of a surety bond in an amount deemed necessary by the director of public works to compensate for any injury, damage or casualty to any roadway, bridge, structure, foundation or other public property.
(d)
Possession of permit; compliance with permit; inspection of vehicles. The special permit furnished by the city shall be carried in each vehicle or combination of vehicles to which it refers, and all such vehicles shall be open to inspection by a police officer or the director of public works or his authorized agent or inspector. No person, firm or corporation shall violate any of the terms or conditions of any ordinance regulating the weight and length of vehicles or combinations thereof or the conditions, restrictions and regulations of special permits issued under this section.
(e)
Criteria for granting. In addition to consideration of those rules and regulations as prescribed in subsection (b) of this section, the director of public works may consider the following factors when acting upon an application for a permit:
(1)
The ability of bridges on the route specified in the permit application to accommodate loads in excess of the maximum amounts permitted by other city ordinances or state law.
(2)
The ability of trucks which are longer than the length permitted by other city ordinances or state law to be operated on the route specified in the application in compliance with city traffic ordinances and state statutes.
(3)
The impact which issuance of a permit would have on the safe and orderly movement of traffic on the route specified in the application.
(4)
The impact which issuance of a permit would have on the safety of pedestrians and the maintenance of curbs, sidewalks and pavements on the route specified in the application.
(f)
Termination. The director of public works may at any time and in his discretion terminate any or all special permits issued under this section. Such termination shall be effective 14 days from the date written notice of termination is mailed to the special permittee at the address designated on the application.
