§ 62-121. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Buyback center means a location where source-separated materials from households and small businesses are redeemed and containerized for transporting to a materials recovery facility or to markets for recovered materials. The household or business is paid for the source-separated materials.
Clean fill means uncontaminated soil, rock, sand, gravel, concrete, asphaltic concrete, cinderblocks, brick, minimal amounts of wood and metal, and inert solids as approved by the state department of natural resources for fill, reclamation or other beneficial use.
Commercial incinerator facility means a facility that processes solid waste from more than one household, farm, institution or business establishment or at a location that is not on the generator's site using a device or structure resulting in weight or volume reduction of the solid waste by combustion.
Compost facility means a facility that processes solid waste into a stable nuisance-free humus-like product using a controlled process of microbial degradation of organic materials.
Demolition landfill means a permitted solid waste disposal area employing an engineered method of disposing of solid wastes, such as demolition waste, construction materials, brush, wood waste, soil, rock, concrete and inert solids insoluble in water, on land in a manner that minimizes environmental hazards by spreading the solid wastes in thin layers, compacting the solid wastes to the smallest practical volume and applying cover at least once every seven days.
Dropoff center means a manned location where source-separated materials from households or small businesses can be dropped off for delivery to a materials recovery facility. The household or business is not paid for the source-separated materials.
Dropoff station means an unmanned location where recycling containers are placed for the deposit of source-separated materials from households.
Facility means a combination of buildings, building appurtenances, equipment, machinery, structures and devices necessary and common to the activity for which it is intended, and includes the tract of land on which the facility is located or on which the facility is confined in the event of a large tract.
Incinerator means a solid waste processing facility consisting of any device or structure resulting in weight or volume reduction of solid waste by combustion.
Infectious waste means a solid waste capable of producing an infectious disease because it contains pathogens of sufficient virulence and quantity so that exposure to the waste by a susceptible human host could result in an infectious disease.
Leachate means liquid that has percolated through solid waste and has extracted, dissolved or suspended materials from it.
Materials recovery facility (MRF) means a facility where bulk loads of source-separated materials are separated and processed into marketable industrial feedstocks for manufacturers of new products.
Municipal solid waste means nonhazardous waste, including garbage, trash, yard waste and other materials generated in households, commercial establishments and institutions and light industrial wastes. It excludes industrial process wastes, agricultural wastes, mining wastes and sewage sludge.
Municipal solid waste separation facility means a facility where mixed municipal solid waste is separated into recovered materials and other components either manually or mechanically and further processed for transporting to other facilities, including a solid waste disposal area.
Open dump means a solid waste disposal area at which solid wastes are disposed of in a manner that does not protect the environment, are susceptible to burning and are exposed to the elements, vectors and scavengers.
Recovered materials and recyclables mean items which are separated from solid waste to be used in the manufacture of a product.
Recycling means the separate use and reuse of materials which might otherwise be disposed of as solid waste.
Recycling center means any collection (not manufacturing) facility or system that accepts source-separated materials for resale to markets for resource recovery, for example, aluminum cans and scraps, tin, copper, glass, paper products, tires, plastics, bimetal and steel containers, and ferrous and nonferrous metals.
Salvaging means the controlled removal of solid waste materials for utilization.
Sanitary landfill means a permitted solid waste disposal area employing an engineering method of disposing of solid wastes on land in a manner that minimizes environmental hazards by spreading the solid wastes in thin layers, compacting the solid wastes to the smallest practical volume and applying cover at the end of each operating day.
Solid waste means garbage, refuse and other discarded materials, including but not limited to solid and semisolid waste materials resulting from industrial, commercial, agricultural, governmental and domestic activities, but does not include overburden, rock, tailings or other waste material resulting from mining, milling or smelting. The term "other waste material," as used in this definition, means inert solids insoluble in water.
Solid waste disposal area means any area used for the disposal of solid waste from more than one residential premises, or one or more commercial, industrial, manufacturing, recreational or governmental operations.
Source-separated materials means the waste products, for which markets exist, which have not been commingled with solid waste, but have been kept separate from other wastes at the point of generation.
Special wastes means wastes which are not regulated hazardous wastes, which have physical or chemical characteristics that are different from municipal, demolition, construction and wood wastes, and which potentially require special handling.
Transfer station means a solid waste facility utilized as a central collection point at which municipal solid waste from collection trucks is placed in long-haul carriers for transfer to a municipal solid waste separation facility or to a solid waste disposal area.
Waste processing means an operation such as shredding, compaction, composting, separating and incineration by which the composition or the physical or chemical properties of solid waste are changed or recovered materials are separated from solid waste.
Waste tire means a tire that is no longer suitable for its original intended purpose because of wear, damage or defect.
Yard waste compost facility means a facility that processes grass, leaves, brush and other organic landscape wastes from more than one household, farm, institution or business establishment.
