§ 60-156. Report of changed conditions.

  • (a)

    Each industrial user shall notify the director of any planned significant changes to the industrial user's operations or systems which may alter the nature, quality or volume of its wastewater at least 60 days before the change. The industrial user shall submit such information as may be deemed necessary by the director to evaluate the changed condition, including a wastewater discharge permit application.

    (b)

    The director shall respond to said notice within 60 days. He may issue a wastewater discharge permit or modify an existing wastewater discharge permit in response to this notice. No industrial user shall implement the planned changed conditions(s) until and unless the director has responded to the industrial user's notice.

    (c)

    For purposes of this requirement, flow increases of more than ten percent or the discharge of any previously unreported pollutant shall be deemed significant changes.
