§ 56-316. Compliance with orders of director.

  • (a)

    The building or structure shall be repaired within the time specified by the director or it shall be temporarily closed in accordance with this code. No person shall occupy, remain in or enter any building which has been so posted or allow or permit such entry or occupancy by any other person until conditions necessitating the posting have been remedied; except that access under a permit shall be allowed to secure the building or structure from unlawful or unauthorized entry or deterioration, to repair, demolish or remove such building or structure, and to remove personal property.

    (b)

    The owner of the building or structure may make an application to the director for access to the building or structure at any time after the order to vacate becomes effective. The application, which shall be made on a form prescribed by the director, shall set forth the owner's name and address, the name, address, social security number, and date of birth of all persons sought by the owner to enter the building or structure, and the purposes for which access is being requested. The application shall be signed and dated by the owner. The owner is required to obtain all proper permits required under the Code of General Ordinances of the City of Kansas City, specifically including and not limited to the building code and zoning ordinance from the department of codes administration.

    (c)

    Upon proper application by the owner, the director shall issue an access permit if the permit is sought for one or more of the purposes set forth in subsection (a) above. The permit shall allow access to the building or structure under the following conditions, which shall be set forth in the permit:

    (1)

    The access shall be permitted for a period of not more than 30 days from the date of the permit issuance, after which time access shall not be permitted. Prior to granting any extension beyond the permit period, the property must be reinspected;

    (2)

    Access shall be permitted only between the hours of 6 a.m. and 10 p.m. and shall not be permitted between the hours of 10 p.m. and 6 a.m. The work access permit must be available at all times upon request; and

    (3)

    The issuance of the permit does not stay the enforcement of any of the provisions of this Article II.

    (d)

    Upon repair of any building or structure which has been posted by the director under section 56-314, an inspection shall be requested of and made by the director. If such building is determined to be fit for human occupancy, a certificate of reoccupancy so stating shall be issued.
