§ 50-203. Sale of individual cigarettes prohibited.

  • (a)

    Definitions. As used in this section, the following terms mean:

    Cigarettes means any roll for smoking made wholly or in part of tobacco irrespective of size or shape and whether or not such tobacco is flavored, adulterated or mixed with any other ingredient, the wrapper or cover of which is made of paper or any other substance or material except tobacco.

    Package means a quantity of cigarettes wrapped and sealed in paper, tinfoil or otherwise by the manufacturer of cigarettes prior to being placed in cartons and for shipment from the manufacturer.

    Sale means any transfer of title or possession, or both, exchange or barter, conditional or otherwise, in any manner or by any means whatsoever for a consideration of any agreement therefor.

    (b)

    No person shall sell or display for sale any cigarettes unless they are contained within the original package. No person shall sell, offer for sale, or display for sale any package which has been tampered with or altered from the original package provided by the manufacturer.
