§ 50-159. Harassment.

  • (a)

    It shall be unlawful for any person, for the purpose of frightening, intimidating, causing substantial emotional distress or disturbing another person or with the result of frightening, intimidating, causing substantial emotional distress or disturbing another person of reasonable or average sensibility to:

    (1)

    Communicate in person, by telephone, in writing, by fax machine or facsimile transmission or by other electronic communications device a threat that would place that other person in reasonable fear of death, physical injury or financial harm or reasonable fear of the same to a family member or acquaintance;

    (2)

    Make a telephone call(s), communicate in person, in writing, by fax machine or facsimile transmission or by other electronic communications device, and use any coarse, vulgar or profane language offensive to one of average sensibility;

    (3)

    Make a telephone call anonymously or using a spurious name or send a written or electronic communication anonymously or using a spurious name; or

    (4)

    Make repeated telephone calls or send repetitive written messages or messages by fax machine or facsimile transmission or by other electronic communications device to another.

    (b)

    It shall be unlawful for any person to knowingly permit any telephone, fax machine or other electronic communications device under his/her control to be used for any purpose prohibited by this section.

    (c)

    It shall be unlawful for any person to commit acts described in subsection (a) herein if these acts are directed toward, or received by, a telephone, a telephone answering device, a voice mail system, electronic facsimile (fax) equipment or any other electronic communications device.
