§ 40-366. Unattended businesses.

  • Every business operation in the city, designed to operate without an attendant on duty continuously while open to the public, shall be required to have posted in a conspicuous place the telephone number of the fire department and the police department, and the address and telephone number where the owner, operator or person in charge of such operation can be reached in case of emergency. Such owner, operator or person in charge shall personally call at the establishment at least once each day it is open to the public and remain on duty long enough and at such times as is necessary to keep the establishment in a clean and sanitary condition, to provide safety to the public, and to prevent any loitering, unlawful activity or nuisance therein or thereon. The establishment shall be so arranged that the entire interior thereof, except restrooms and toilets, can be observed from the outside and so that there are no hidden rooms, alcoves or areas accessible to the public that cannot be so observed. The premises, including parking areas, shall be adequately lighted at all times the premises are open for business.
