§ 40-337. Aviation schools at airport.

  • (a)

    License required. No person shall engage in, carry on or conduct the operation and maintenance of an aviation flying school upon any airport within the city limits without first obtaining a license therefor from the commissioner of revenue.

    (b)

    Definitions. For purposes of this section, the following terms shall have the meaning given in this subsection:

    (1)

    Aviation flying school means a school for the training or instruction of students in aviation operation and conducted commercially, and does not include instruction given with the sale of aircraft.

    (2)

    Aviation operation means the act of operating aircraft through the air.

    (3)

    Aircraft has the meaning given in section 40-331.

    (c)

    Compliance with applicable regulations. Aviation flying schools shall operate and conform to the rules and regulations pertaining to such schools as promulgated by the Federal Aviation Agency, and the rules and regulations of the airport.

    (d)

    Application for license. Every person engaged in the operation or maintenance of an aviation flying school, as defined in this section, shall make an application for such license to the commissioner of revenue of the city, setting forth the name of the applicant, and if an individual his place of residence, and if a firm the names and places of residence of all its members, and if a corporation the names and places of residence of all its officers, and such application shall also state the place of business of such applicant.

    (e)

    License fee. The license fees required in this section shall be based upon the number of aircraft owned or operated by such flying schools, and shall be as follows:

    (1)

    For 20 aircraft or less, per year ..... $32.00

    (2)

    For more than 20 aircraft, per year ..... 62.50

    (f)

    Display of license. The license shall at all times be available for inspection by license inspectors and the field manager of the airport.

    (g)

    Transfer of license. No license shall, under any conditions whatsoever, be transferable.
