§ 3-445. Contract award process.

(a)

Whenever a bidder or proposer has submitted a bid or proposal that is not in material compliance with the requirements of this division, the contracting department or incentive agency shall reject the bid or proposal unless the goals are waived pursuant to section 3-437.

(b)

If, after a contract is awarded, it is determined that a solicitation or award is in violation of this division, the contractor or developer may continue performance if the department director or incentive agency head makes a written determination that it is in the best interests of the city or the incentive agency, without prejudice to any other legal remedies available to it under the contract.
