§ 34-514. Right of entry.

  • Whenever necessary to make an inspection to enforce any of the provisions of this article, or whenever the director of health or his authorized representative has probable cause to believe that the presence of a substance described in section 34-512(a) at a site presents an immediate, clear and present danger to health or the environment, the director of health or his authorized representative may enter such site at all reasonable times to inspect the site or to perform any duty imposed upon the director of health by this article; provided that, if such site is occupied, he or she shall first present proper credentials and request entry, and, if such site is unoccupied, he or she shall first make a reasonable effort to locate the owner or other persons having charge or control of the site and request entry. If such entry is refused, the director of health or his authorized representative shall have recourse to every remedy provided by law to secure entry.
