§ 2-1872. Purchase of tropical hardwoods.

  • (a)

    Definitions. As used in this section, the following terms shall have the meanings given in this subsection:

    (1)

    Tropical hardwood means any and all hardwoods, scientifically classified as angiosperms, that grow in any tropical moist forest. Tropical hardwoods shall be the following species:

    (2)

    Tropical hardwood products means any wood products, wholesale or retail, in any form, including but not limited to veneer, furniture, cabinets, paneling, moldings, doorskins, joinery or sawnwood, which are composed of tropical hardwood.

    (b)

    Except as provided in this section, the city shall not purchase or obtain for any purpose any tropical hardwoods or tropical hardwood products, wholesale or retail, in any form.

    (c)

    The provisions of subsection (b) of this section shall not apply to:

    (1)

    Any tropical hardwoods or tropical wood products purchased from a sustained, managed forest; or

    (2)

    Any binding contractual obligations for purchase of commodities entered into prior to December 21, 1991.

    (d)

    No bid specification, invitation, solicitation or request for bid or proposal or contract for the construction of any public work, building maintenance or improvement for or on behalf of the city shall require or permit the use of any tropical hardwood or tropical wood product, except as provided in subsection (c) of this section.

    (e)

    Every bid specification, or invitation, solicitation or request for bid or proposal, for the construction of any public work, building maintenance or improvement shall contain a statement that any bid, proposal or other response to an invitation, solicitation, or request for bid or proposal shall propose or call for the use of any tropical hardwood or tropical hardwood product not from a sustained, managed forest in the performance of the contract. No contract shall be let on the basis of any bid, proposal or response to an invitation, solicitation, or request for bid or proposal which proposes or calls for the use of any tropical hardwood or tropical hardwood product in the performance of the contract unless the contractor or bidder agrees to substitute for the tropical hardwood or tropical hardwood product a nontropical wood or wood product of comparable quality at the same or lower price than that proposed, or unless the contractor or bidder demonstrates to the satisfaction of the city that the tropical hardwood or tropical hardwood product is from a sustained, managed forest.

    (f)

    The provisions of subsection (d) of this section shall not apply:

    (1)

    To bid packages advertised and made available to the public or any competitive and sealed bids received or entered into prior to December 21, 1991; or

    (2)

    If the use of tropical woods is deemed necessary for purposes of historical restoration and there exists no available acceptable nontropical wood species.
