§ 2-1072. Adoption of position classification plan; participation in labor organizations by supervisors.

  • (a)

    In pursuance of the provisions of section 116 of article V of the Charter, the classification of all positions in the classified service as made and promulgated by the director of human resources, with the approval of the city manager, with such amendments or changes as may be made thereto, are hereby adopted as the classification plan for all positions in the classified service. Such classification plan is filed as Document No. 29744, captioned "Position Classification Plan," dated March 1964, as amended, in the office of the director of records, and is hereby adopted and incorporated in this section by reference. The titles of the classes of positions named and described in the position classification plan shall forthwith become the official titles of all positions allocated to the respective classes and shall be used on all payrolls, budget estimates and personnel records; provided that any abbreviation or code symbol approved by the director of human resources may be used in lieu of the title to designate the class of position in any such connection, and any other title desired by the appointing authority may be used to designate any position for purposes of internal administration or in any other connection not involving the personnel and classification process covered by the Charter or the rules of the human resources department.

    (b)

    For purposes of this section:

    (1)

    Supervisor means any individual having authority, in the interest of the city, to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward or discipline other employees, or responsibly direct them, or to adjust their grievances, or effectively to recommend such action, or who is excluded from coverage as a supervisor by any memorandum of understanding between the city and any labor organization.

    (2)

    Managerial employee means any individual who formulates, determines or executes management policies.

    (3)

    Confidential employee means any individual whose unrestricted access to confidential personnel files or information concerning the administrative operations of the city, or whose functional responsibilities or knowledge in connection with the issues involved in the process of dealing with labor organizations, would make his membership in the same organization as nonconfidential employees incompatible with his official duties.

    (c)

    Any supervisor, as defined in this section, is forbidden to join or maintain membership or engage in activities of any labor organization which admits to membership, or is affiliated directly or indirectly with an organization which admits to membership, nonsupervisory employees who work under the direction of such supervisors, or otherwise are engaged in the type of work performed by such nonsupervisory employees.
