§ 2-234. Fee for lift assists.

  • (a)

    Any facility that is licensed by the state department of health and senior services pursuant to RSMo 198.015, as a residential care facility, assisted living facility, intermediate care facility, or skilled nursing facility or that meets the definition of a dialysis facility pursuant to section 494.10 of title 42 of the Code of Federal Regulations (42 C.F.R. 494.10) shall pay a fee to the fire department when the fire department has provided a lift assist at any such facility. Such fee shall be determined and set by the fire chief and shall be an amount reasonably calculated to defray the costs of a lift assist.

    (b)

    The term "lift assist" as used in this section means a response by a fire department suppression or rescue company to a facility that has requested assistance to physically move a person who does not require from the fire department, and is not provided by the fire department, any emergency medical services or any services related to patient transportation, care, treatment or health care.
