§ 28-72. Responsibility of appeal board.

Where an application for a floodplain development permit from the floodplain management regulations is denied by the floodplain administrator, the applicant may apply for such floodplain development permit directly to the appeal board, as defined in section 28-71.

The building and fire codes board of appeals shall hear and decide appeals when it is alleged that there is an error in any requirement, decision, or determination made by the floodplain administrator in the enforcement or administration of this chapter.

The building and fire codes board of appeals shall hear and decide all requests for a floodplain management variance.
