Sec. 26-403.1.2. Standby personnel, Fireguards.
When, in the opinion of the chief, or fire code official it is essential for public
safety in any place of assembly or other place where people congregate, due to the
number of persons, or the nature of the performance, exhibition, display, contest
or activity, the owner, agent, or lessee shall have one or more experienced on-duty
firefighters, as required and approved by the chief, to be on duty at such place as
a fireguard. A firefighter performing fireguard duties shall be subject to the supervision
of the fire prevention division. The firefighter shall be in proper uniform and remain
on duty during the times such place is open to the public, or when such performance,
display, contest or activity is being conducted. Before each such performance, display,
contest or activity, the firefighter shall inspect the premises of such place for
compliance with the fire prevention code, and shall keep diligent watch for fire during
the time such performance, display, contest or activity is being conducted and take
prompt measure for extinguishment of fires that may occur. Firefighters shall not
be required or permitted, while on duty, to perform any other activity than that of
a fireguard.
Sec. 26-403.1.3. Compensation.
When a firefighter is required by the chief or the fire code official to be on fireguard
duty at such place of assembly, the person in charge of the assembly shall compensate
the City at the equivalent of the prevailing fireguard wage rate, per hour for a minimum
of four hours, per fireguard. The prevailing fireguard wage rate shall be the firefighters
existing hourly salary rate for overtime.
