§ 10-40. Penalty for violation of chapter.

  • (a)

    Any person violating any provision of this chapter shall be deemed guilty of an ordinance violation. The municipal court shall have the power to hear and determine alleged violations of the provisions of this chapter. All persons convicted of violations under this chapter shall be punished by a fine of not less than $50.00 and not more than $1,000.00, or by imprisonment for a term not to exceed six months, or by both a fine and imprisonment, where no other penalty is specifically provided for in this chapter. A person who fails to pay any fine assessed upon conviction under this chapter may be committed until the fine is paid at the current per diem rate and the judgment of the court satisfied.

    (b)

    Each day that a violation of this chapter continues shall be deemed a separate offense and shall be proceeded against as in the first instance. In addition, any violation of any provision of this chapter shall be grounds for suspension or revocation of any license or permit after a hearing before the board, as provided for in this chapter.
